The defendant, driving his pickup truck south on Strickland Road in Wake County, at about nine o'clock in the morning of November 5, 1957, overtook plaintiff's intestate, Wiley Jones, walking south along the highway. The defendant recognized Jones, stopped his truck, and invited him to ride.
