The appellant is the city of Franklin, Ohio, whose council, on January 7, 1957, passed Ordinance No. 1956-29, entitled "An ordinance providing for an excise tax on water and sewer bills in the city of Franklin, Ohio, and to declare an emergency." Certain sections of the ordinance provide as follows:
