GRUBB, District Judge.

Defendants were indicted on a charge of transporting a Shetland pony1 in interstate commerce, knowing it to be stolen, in violation of Section 2314, Title 18 United States Code. Defendants have moved to dismiss the indictment on the ground that the Shetland pony is not within the terms of the statute. The pertinent portion of the statute reads:

"Whoever transports in interstate * * * commerce any goods...
