PRESIDING JUSTICE LEWE delivered the opinion of the court.

Defendant was charged with driving a motor vehicle while under the influence of intoxicating liquor in violation of section 47 of the Uniform Act Regulating Traffic, Ill. Rev. Stat. 1957, ch. 95 1/2, § 144. Upon a plea of not guilty and waiver of a jury, the court found defendant guilty and assessed a fine of $106 and ordered that his driver's license be revoked for one year. Defendant appeals.
