This is an original petition for workmen's compensation and medical and hospital expenses. It was heard by a trial commissioner who denied and dismissed the petition and a decree was entered containing the following findings of fact: "(1) That the petitioner has failed to prove by a fair preponderance of the evidence that his injuries caused by the automobile accident on October 20, 1956 on a public highway arose out of and in the course of his employment...
