Appellant was charged with the crime of robbery. The affidavit charged that appellant "... did ... forcibly by violence and putting ... in fear, ..." take certain money from one Frank Rice. The jury found the appellant guilty of the included offense of assault and battery with intent to commit robbery.

The error assigned is the overruling of appellant's motion for a new trial. The motion listed the following four reasons as grounds for a new trial...
