This prosecution was commenced in the police court of the city of Wichita, charging defendant (appellant), Edgar N. Houchens, with violation of the penal code of that city. He was tried and convicted for the offense as charged. Thereafter, as authorized by G.S. 1949, 13-611, he appealed to the district court of Sedgwick county from the order and judgment of the police court.
