OPINION.

Mr. Chief Justice BLUME delivered the opinion of the court.

This is an action for damages brought by the plaintiff, Harold D. Wilmes, against Lee O. Hinton and the Atlantic Refining Company by reason of injuries sustained by the plaintiff in being thrown out of a Dodge truck driven by Lee O. Hinton, an employee of the Atlantic Refining Company, on November 1, 1956. The court gave judgment in favor of the plaintiff in the sum of $8,719 and costs...
