This is an appeal by the plaintiff from a judgment for the defendant upon sustaining a demurrer to the amended petition, on the ground that it did not state a cause of action and was incapable of amendment so as to state a cause of action. Consequently, on this appeal, we are concerned with the allegations of the amended petition alone.
