This is a divorce action. The action went to trial on allegations of extreme cruelty, a general denial by defendant as to those allegations, and a cross-petition by defendant seeking a divorce from plaintiff. At the close of plaintiff's case the defendant announced that he would offer no evidence and moved to dismiss his cross-petition without prejudice. Plaintiff made no objection.
