This action, one for malpractice against the defendant, a chiropractor, has been twice tried and is now before this court on its merits a second time. At the first trial, the jury rendered its verdict for defendant, following which plaintiff's motion for a new trial was granted on the ground of the insufficiency of the evidence to support the same. This order was affirmed (Brown v. Guy, 144 Cal.App.2d 659
