ROBINSON, Justice.

Appellant, Lee Mode, was charged with first degree murder. He appeals from a conviction of second degree murder.

One of the points argued by appellant is that the evidence is not sufficient to sustain the verdict. This point is not well taken. There was bad blood between Mode and the deceased, Russell. This grew out of Mode's alleged attentions to Mrs. Russell. It appears that on another occasion Russell had taken a pistol away from Mode...
