These two appeals were heard jointly because of the similarity of the questions they present respecting application of the doctrine of res judicata.

The facts in No. 2322 are that Muse and Lowery were driving automobiles which collided and injured Parker, a passenger in Muse's car. Parker sued and recovered judgment against both Muse and Lowery. Thereafter Lowery and his insurance carrier...
