At about 1:15 a. m. on September 19, 1954, Robert F. Davis was instantly killed when the automobile he was driving ran into one of the cars of defendant's freight train at the railroad crossing maintained by defendant over Illinois State Highway No. 159 about a mile south of Edwardsville, Illinois.
