Appellant, Leroy Smith, was charged by Information on September 23, 1958, with the crime of Manslaughter. On April 6, 1959, appellant demurred to the information as follows:

"Defendant Leroy Smith demurs to the information herein and says the information does not charge this defendant with a crime and does not state facts sufficient to charge him with a crime and does not state facts sufficient...
