This action of the case in assumpsit was brought by the plaintiff as the beneficiary in a mortgage term policy of insurance issued by the defendant upon the life of her husband. The case was tried before a justice of the superior court sitting with a jury and resulted in a verdict for the plaintiff for the full amount of the policy.
