This is an action by Leonard Helms, a citizen of Bristol, Virginia, against Tianada Leonard, a citizen of Bristol, Tennessee, for damages in the amount of $75,000 for injuries he suffered in an automobile accident.

By agreement of counsel, this action was heard and tried by the Court without a jury. At the conclusion of the evidence the defendant moved for a dismissal under Rule 41 F.R.Civ.P., 28 U.S. C.A. and assigned grounds therefor...
