Because of the disposition prior to trial of all other claims, the suit in its present posture now embraces only a demand for damages for the alleged infringement of claim 2 of reissue patent No. 21,323 issued to the plaintiff Jesse D. Langdon on January 16, 1940. The original patent was granted on March 23, 1937, and, therefore, the reissue patent expired while this action was pending.
