No. 381.

107 S.E.2d 152 (1959)

249 N.C. 625

John L. MOORE, Jr. v. AMERICAN NATIONAL FIRE INSURANCE COMPANY OF NEW YORK.

Supreme Court of North Carolina.

February 25, 1959.

Attorney(s) appearing for the Case

Deal, Hutchins & Minor, Edward Pullen, Jr., Winston-Salem, for defendant appellant.

Hastings, Booe & Mitchell, Winston-Salem, for plaintiff appellee.

WINBORNE, Chief Justice.

Taking the evidence offered by plaintiff, as shown in case on appeal, in the light most favorable to him and giving to him the benefit of every reasonable intendment upon the evidence and every inference to be drawn therefrom as is done in considering a motion for judgment as of nonsuit, this Court is of opinion and holds that the evidence is sufficient to support the verdict returned by the jury, and the judgment rendered thereon.
