This case is before us on a writ of error sued out by Robert K. Shito, defendant, from his conviction in the Circuit Court of the Second Circuit for perjury. The case was initiated on August 11, 1956, when the circuit judge summarily committed the defendant for trial. However, the grand jury did not indict the defendant until May 7, 1958. Thus, there was an interval of 1 year 8 months and...
