This is a suit filed by petitioner, O. G. Price, against the defendant, Mutual Benefit Health and Accident Association, referred to as "Mutual of Omaha". The suit is to require the defendant to accept annual premiums on a certain insurance policy issued to petitioner or, in the alternative, for a judgment in the amount of $5,819, which sum includes damages as well as premiums paid by petitioner.
