This is a malpractice action instituted by plaintiffs Moses Dinner and Myra Dinner, husband and wife, against the defendant Dr. Donald J. Thorp.

On October 25, 1955, Mrs. Dinner engaged the defendant doctor, a specialist in obstetrics and gynecology, to care for her during her second pregnancy and to deliver her expected child.
