This matter comes before this court upon an appeal on questions of law and fact. In this court Joe Swartz, plaintiff, appellant herein, filed an amended petition naming as defendants, appellees herein, Harris Carmen, Rose Koshel, and Newton A. Thatcher, Treasurer of Franklin County, Ohio.
