Plaintiff in error, to whom we will refer as defendant, and one Trujillo, were convicted on both counts of an information charging unlawful possession of Cannabis Sativa L., commonly known as marijuana, and conspiracy to unlawfully possess the said narcotic. After a timely motion for judgment notwithstanding the verdict, or in the alternative for a new trial, defendant was sentenced to the state penitentiary for a term of not less than three nor more...
