Plaintiff, Gladys Kirby Fisher, sued Harold Martin Franke, defendant, to recover damages for personal injuries allegedly sustained as a result of a rear-end collision occurring on February 18, 1955, on Post Oak Road in the city of Bellaire, Harris County, Texas.
