Samuel Nieberg, defendant below, has appealed from a judgment against him in the sum of $37,261.42 following a bench trial in the District Court. He relies for reversal on alleged errors arising "out of failure of the District Court to properly apply Missouri law as to the liability of the defendant and findings of fact contrary to the evidence."
