This is an action involving the validity and construction of a portion of Sec. 26 of Article 1269m, Vernon's Texas Annotated Civil Statutes, known as the Firemen's and Policemen's Civil Service Act, as amended by Act of the 54th Leg., R.S.1955, Ch. 255, p. 709. This section was again amended by the 55th Leg., R.S.1957, Ch. 391, Sec. 6, but as last amended is not involved here. The question at issue is whether Sec. 53, Art. 3 of the State Constitution...
