Respondent Prieth, defaulting purchaser of an automobile under a conditional sale contract, has brought this action against Gaudin Motor Co. of Las Vegas, the conditional vendor. The car had been repossessed and resold by Gaudin for a sum greater than the balance due under the contract of sale. Prieth seeks to recover that surplus.
