HINES v. STATE

No. 30763.

327 S.W.2d 755 (1959)

James Harold HINES et al., Appellants, v. STATE of Texas, Appellee.

Court of Criminal Appeals of Texas.

June 24, 1959.

Attorney(s) appearing for the Case

David Longoria, Austin, for appellants.

Leon B. Douglas, State's Atty., Austin, for the State.

WOODLEY, Judge.

This is an appeal from a bond forfeiture.

But one point is raised by appellants' brief which is the contention that the trial court erred in overruling their motion for new trial based upon a claimed material variance between the appearance bond and the judgment nisi, and the contention that the judgment is contrary to the evidence.

We find no statement of facts in the record.
