Plaintiff, as tenant, occupies a portion of the premises belonging to the defendant in the City of Yonkers under the terms of a 10-year lease entered into between the parties on September 26, 1952. The space leased consists of approximately two thirds of the area of the building. Plaintiff, in addition, has the right to use the rear yard for parking jointly with other tenants.
