This is an action for wrongful death brought by James D. Mabe, administrator of the estate of Robert Mabe, deceased, for the benefit of the next of kin, for pecuniary loss resulting from the death of plaintiff's decedent. The defendant denied negligence on his part and alleged contributory negligence of plaintiff's decedent. The trial court directed a verdict for the plaintiff for funeral expenses only.
