This is an attempted appeal from the district court for Douglas County. It involves an equity action tried in the district court on November 14, 1958. At the conclusion of the trial counsel for certain of the defendants moved to dismiss plaintiff's petition because, as he claimed, the evidence adduced was insufficient to sustain plaintiff's burden of proof.
