Plaintiff instituted this action to recover damages for alleged malicious prosecution. The cause was tried before the court sitting without a jury, resulting in a judgment in favor of defendants from which plaintiff appeals.

Prior to the events to be related, plaintiff Raymond D. Clary had been in the trucking business about 15 years and was the owner of a truck and refrigerated trailer which he used for long-distance transportation of foodstuffs...
