In an action for a declaratory judgment, defendant Erling Stange moves to dismiss the complaint pursuant to rule 107 of the Rules of Civil Practice, on the ground that there is an existing final judgment between the parties, determining the issues herein. Defendant Eyda Stange moves to dismiss the complaint on the ground that it fails to state a cause of action as to her.
