Tom M. Pogue sued and recovered judgment for attorney's fees in Nueces County against Ted Musick, LeVoy Musick and Bob Heath, a firm of lawyers in Houston, Texas. Defendants failed to appear at the hearing of their pleas of privilege on October 17, 1958, and, though they answered, again failed to appear when Pogue recovered judgment on the merits, December 22, 1958.
