Petitioners are the owners of approximately 140 acres of land located in Milwaukee county.

In February, 1956, the city of Milwaukee common council adopted an ordinance purporting to annex to the city territory which included petitioners' property. The validity of the annexation ordinance is presently contested in the courts by the village of Brown Deer.
