Upon a trial before the court without a jury appellant was convicted of negligent homicide in the first degree and his punishment assessed at one year in jail.

Appellant and the deceased were members of the police force of the City of Houston. On the morning of the homicide the two got off duty around 6 A. M. Later in the morning after having changed to civilian clothes they went to Coleman's Inn at 846 West 27th in the City in company...
