This is a petition for writ of habeas corpus by Chester F. Hibbs whereby he seeks his release from the state penitentiary at McAlester, Oklahoma.

The record reflects that petitioner is confined in the state penitentiary by virtue of a conviction in the District Court of Oklahoma County, for the crime of first degree burglary, after a former conviction of a felony wherein petitioner was sentenced to serve the term of 99 years in the Oklahoma State...
