This appeal is from that portion of a decree in admiralty dismissing the third-party petition filed by the appellants, hereinafter called Nardelli, against the appellee, hereinafter called Stuyvesant. The libel was filed by another maritime insurance company which had become subrogated to the rights of the owner of the M/V Lolita to recover from those responsible for her sinking.
