PER CURIAM.

This case is before us on a Clerk's transcript. Defendant was indicted, tried and convicted of the crime of breaking and entering. He was sentenced to imprisonment in the Iowa State Penitentiary at Fort Madison for a period not to exceed 10 years, as provided in Section 708.8, 1954 Iowa Code, I.C.A., from which judgment he has appealed.

Finding no error in the record the judgment is affirmed.
