Defendant has appealed from a judgment of conviction of driving an automobile while under the influence of intoxicating liquor.

The following facts were adduced at the trial: John Bevan, a policeman and witness for the state, testified that about 3:00 a.m., the morning of October 16, 1956, he found the defendant in his car which was parked, with motor running, in or partially in the traffic lane of a public street in Billings, Montana...
