Appellant was convicted on February 28, 1951 in Suffolk County Court on his plea of guilty of sodomy, second degree, attempted rape, second degree, and attempted sodomy, second degree. The indictment under which the convictions were had on the plea charged all three crimes in the first degree and all three on the same day, July 10, 1950. The sentence of the court was 5 to 10 years each on the attempted rape and the attempted sodomy...
