This is an appeal from an order in a declaratory judgment suit wherein the plaintiff, R. F. Scheig, Sally Scheig Simons and husband, C. B. Simons, and Midwest Oil Corporation, sought an adjudication that their term royalth in 575 acres of land in San Patricio County was in full force and effect. The defendants, Weldon Winsauer, J. P.
