Adam Hat Stores, Inc., hereinafter referred to as plaintiff, instituted this action in the Circuit Court of Jackson County to recover from Kansas City, hereinafter frequently referred to as "the city", the sum of $3,812.49 for damage by water to certain of its merchandise resulting from a break in the city's water main located in the public street in front of plaintiff's store in which the merchandise was kept.
