Plaintiff in error was the defendant in the trial court, and we so refer to him.

He was charged in the information with the crime of burglary in the language of the statute, C.R.S. '53, 40-3-6 wherein it was stated that he did "unlawfully, feloniously, wilfully and maliciously break and enter, and wilfully enter a railroad car * * * with intent therein to commit the crime of larceny; * * *."
