This is an appeal from a judgment in favor of the respondent for personal injuries sustained when certain lumber fell upon him.

In the complaint it was alleged that on August 10, 1953, the defendant negligently loaded, stacked and placed certain lumber owned by Hill and Morton, Inc., on a railroad flat car and caused the same to be shipped to Anawalt Lumber and Material Company, at Pacoima, California.
