OPINION

Mr. Chief Justice Blume delivered the opinion of the court.

This is an action brought by the Town of Worland, a municipal corporation organized as a town, against Odell and Johnson and Veterans Homes Company for declaratory judgment as to the liability of the town under the circumstances hereinafter mentioned. Odell and Johnson, on behalf of the Veterans Homes Company, filed cross petitions demanding either judgment against the town for $25,808.57...
