Respondent Accarino was the owner and operator of an automobile which collided with the automobile owned and operated by appellant Hirsch. He instituted an action against the appellant (Action No. 1) to recover damages for injuries to person and property. Three passengers in Accarino's car and the husband of one of them instituted an action against Accarino and Hirsch (Action No. 2) to recover damages arising from the accident.
