This is an action of tort by the administratrix of the estate of Michael C. Ghiz to recover for his death and conscious suffering resulting from being struck by the defendant's automobile. The case was tried on counts 2 and 3 of the plaintiff's declaration which alleged respectively that the death and conscious suffering were caused by the defendant's negligence.
