Upon a trial before the Court without a jury under a plea of not guilty, appellant was convicted of driving a motor vehicle upon a public highway while intoxicated and his punishment assessed at confinement in jail for 3 days and a fine of $100.

The sole question presented is the sufficiency of the evidence to show that appellant was the driver of the motor vehicle.
